What does the term ‘Misdiagnosis and Delayed Diagnosis’ refer to?

What could be considered as Late Diagnosis?

When we speak of Misdiagnosis we are generally referring to the circumstances where a medical professional either diagnoses you with the wrong condition, or completely misses the problem altogether.

Often, Misdiagnosis occurs when your doctor or consultant fails to perform a thorough examination, refers you to the wrong specialist or perhaps even incorrectly interprets the results of tests. 

Whilst Misdiagnosis can be made for any number of illnesses and diseases, the most common (and arguably the most serious) tend to be Cancer, Diabetes and Meningitis.

How do I make a claim?

Simply by contacting us at the first opportunity. The earlier we speak, the easier it is to capture all the details of your case and start working towards receiving the compensation you deserve.

Our initial free consultation will provide you with all the information you need to pursue your claim and, in cases where the healthcare provider has admitted liability, will allow us to request interim payments to help with any immediate costs you are incurring (e.g. additional medical costs, extra childcare, rehabilitation, travel to appointments etc.).

How long do I have to make a claim?

Not everyone is aware of the fact that they have suffered through Misdiagnosis or Late Diagnosis as the impact of not having received the correct treatment sooner may not be immediately obvious. 

The general rule is that a claim must be made within 3 years of becoming aware of the situation (in the case of a loved one who you believe has died as a result of Misdiagnosis, you must claim within 3 years of their passing). Children can have a claim made upon their behalf any time up until their 18th Birthday and after this date the usual 3 year rule applies

Can I get help to access additional treatment and rehabilitation?

This depends on the individual circumstances of the case in question and whether the healthcare authority have admitted liability. The severity of your injury and your on-going recovery and rehabilitation needs will also be a factor in the time taken to reach a settlement as we want to ensure that we include every aspect of your future needs in the final sum.
